[Photo|@citizentvkenya]The issue of alleged non-compliance with the court order of IEBC granting NASA, access to its servers, took centre stage at the Supreme Court, Tuesday afternoon.Presidential election petitioner Nasa, accused IEBC, of denying them access to the servers, as the court directed, Monday.Nasa asked for access to the systems, following allegations that the servers were hacked, with aims to subvert election results, in favour of President Uhuru Kenyatta, who was declared president-elect by the IEBC, August 11, after the August 8 polls.In a ruling read by Justice Isaac Lenaola, Monday, the Supreme Court however restricted Nasa’s access to IEBC data and equipment used to conduct the August 8 general election.However, IEBC lawyer Paul Muite denied Nasa's non-compliance allegations, saying IEBC was complying, and was trying to reach its servers in Europe, where some of the people to be communicated about the same, were asleep."The order was issued yesterday morning my Lord but they are telling us that there clients in Europe are asleep. That is where miscommunication is coming from. We will have less time to file a report and present before you. They are not complying with the order," Nasa lawyer James Orengo told the judges, led by Chief Justice David Maraga.However Muite defended IEBC, after Maraga's intervention, saying: "Our clients are here and not sleeping. Our servers are the ones in Europe. We are complying my Lordship but we are only experiencing logistical issues."Maraga further warned all the parties that they should communicate and comply with the order by Tuesday August 29, 5pm, failure to which the court will give a ruling on the party that would not have complied.Earlier, Tuesday, IEBC through its Twitter account said it had complied with the order and that both parties were going on with the scrutiny.However, Nasa lawyer Paul Mwangi and CEO Norman Magaya dismissed the statement, saying IEBC was still defiant to comply.
