The National Assembly Speaker Justin Muturi has dismissed a petition, seeking for the removal of some of the Judicial Service Commission (JSC) members.
Nairobi lawyer Adrian Kamotho Njenga filed it before the 19-member National Assembly Justice and Legal Affairs committee, whose chairman and deputy is Baringo North MP William Cheptumo Kandara MP Alice Wahome respectively.
Njenga who sought to be elected as the Kiharu MP in August 8, 2017, lost his bid to secure Jubilee party to Ndindi Nyoro during nominations.
The lawyer wants Chief Justice David Maraga and his Deputy Philomena Mwilu removed from office.
Other JSC members targeted include Justices Aggrey Muchelule, Mohammed Warsame, Prof Tom Ojienda, Mercy Deche and Emily Ominde.
According to the lawyer, the seven JSC members have a subjective, personalised and vindictive style of handling complaints against judges.
On Tuesday, Muturi dismissed the petition and warned members of the public against attempts to use the Parliament to settle scores.
He cited the constitutional provision which make the Chief Justice JSC chairman, saying anyone who wants removal of the chairman of the JSC, should first seek his removal as the Chief Justice.
“The inclusion of the CJ as a subject of the petition, therefore, is, in itself, misplaced and fatal to the petition," he said.
"The bid by the petitioner, by purporting to move the National Assembly to consider removal of the chairperson of the JSC by using Article 251 of the Constitution, is a long shot, pedestrian and engaging in a fishing expedition,” added Muturi.
As a result, the Speaker said the National Assembly will not be in a position to address itself to the rest of the contents of the petition in light of that material irregularity alone.
"It therefore, follows that this petition falls on its own sword," he said.
