High Court has referred case challenging legality and constitutionality of NASA's People's Assembly to the Supreme Court.
The suit challenging the institution was filed by Attorney General, Githu Muigai, through State Counsel Charles Mutinda.
According to Muigai, the People's Assembly motion was illegal and unconstitutional and therefore the county assemblies should be stopped from passing it.
In the suit, NASA was accused of using public resources in organizing the People's Assembly forums.
“This application is urgent and should be determined on priority basis. There is an ongoing violation of the Constitution and spending of public resources on unlawful activities,” Muigai said
To date, some 14 county assemblies have passed the People's Assembly motion.
The NASA coalition have been pushing for establishment of the People's Assembly as it prepared to swear-in Raila Odinga and Kalonzo Musyoka as the People's President and Deputy President.
