Marimba Investment Sacco has moved to court to challenge the decision by the National Transport and Safety Authority (NTSA) after a motorist was allegedly assaulted to death by the Sacco touts.

Justice Roselyn Aburili has certified the matter as urgent and is set to be heard on January 5. The Sacco that operates 40 matatus says that their business is hurting from grounding the matatus yet they are not to blame for the incident. 

The motorist Joseph Kiarie, died after an altercation with a driver and a conductor of one of the Sacco's vehicles vehicles with registration number KCF 932C.

Joseph Kiarie was laid to rest on January 3rd in Kiambu amid outcry for justice by leaders and family.

Sacco's lawyer Karuku Wachira said the officials voluntarily recorded statements with the police and investigations are in progress.

He added that the Sacco has employed over 80 people paid daily who are suffering yet they had nothing to do with the incident.

He raised concerns since the matatus had been purchased on loans due between 5th and 10th every months and risked auctioneers hammers incase of defaulting in loan payment.Justice Aburili directed Mr Wachira to serve NTSA and the traffic commandant with the court papers before the 5th of January.
