Education CS Fred Matiangi has restructured university governing councils for about 22 universities.
This comes following a High Court ruling that the CS did not have the powers to disband and reconstitute the institutions.
In a case filed over University of Nairobi's council, High Court Judge George Odunga said that though the law allows Matiangi to select members of a council in the ministry, it does not allow him to reconstitute an existing one.
Matiangi has already advertised the post in the local dailies.
“Since section 36 (1) of the Universities Act which the applicant relied upon does not confer power upon the CS to reconstitute the council in the manner it did, the CS clearly acted without or in excess of his power as was properly opined by the Attorney General,” said Justice Odunga.
However, the Attorney General argued that the case had been already passed by events since Matiangi rescinded the announcement.
