Biashara ward MCA who was accused of incitement to violence on Monday denied charges before a Nakuru court.

Stephen Muiruri Kuria who appeared before Chief Magistrate Doreen Mulekyo pleaded not guilty to having committed the crime.

He faced charges of incitement to violence, alleged to have been made on June 20, 2015 at KANU house within Nakuru Township.

According to the charge sheet, Mwiruri uttered words that indicated or implied that the court order was useless as he continued to incite members of the public to destroy modern stalls that were under construction in the township.

It is alleged that he said; “this court order is just a piece of paper which I will tear into pieces” as he went ahead and pulled down the stalls.

Mwiruri was arrested and given a police bond of Sh5,000

On Friday last week, Muiruri was before court but could not take plea as the court declared the charge sheet defective and discharged him under section 89 (5) of the criminal procedure code but State Counsel Sandra Kosgei urged the court to give him time to amend the charge sheet so as to charge the MCA.

He was released on a cash bail of Sh50,000.

The case will be heard on February 24, 2016.
