An MCA in Kisumu has lost his seat after the Kisumu High Court quashed his election on Friday.John Agengo of East Kano Ward will have to return to the drawing board to strategise on how to recapture the post after his opponent, Kenneth Omoro, successfully challenged his election in court.According to Kisumu Senior Principal Magistrate Julius Ng'arng'ar, the Independent Electoral and Boundaries Commission (IEBC) did not follow due process during and after the counting of votes.The judge ordered the electoral agency to set a new date for a by-election.Omoro also in his petition claimed some of his supporters were blocked from going to polling stations to cast their votes, a development that denied him thousands of votes.Agengo became the first Member of the County Assembly in the county to lose his seat although there are other several petitions in court challenging the election of his colleagues.Magistrate Ng'arng'ar ordered Agengo who is the respondent, to pay Sh300,000 to the complainant in costs.There was jubilation outside the Kisumu Law Courts after the judge made the ruling as Omoro's supporters celebrated Agengo's loss.
