A Tana River Member of County Assembly who was suspended for one month for grabbing the speaker’s mace intends to challenge his suspension in court.Garsen Central MCA Masha Boru said the suspension was too harsh, arguing that it violated the standing orders.Speaking in Malindi on Thursday, Boru said he has already begun the court process to seek justice.Section 115 of the Standing Orders state that if any member is suspended, the suspension on the first occasion shall be for four sitting days including the day of suspension.“This is my first offense in the session, I should have been suspended for only four sittings according to section 115 of the standing orders and not a whole month as ordered by the speaker,” said Boru.Tana River speaker Michael Justin Nkaduda on Wednesday suspended the MCA for disorderly misconduct following the incident which occurred two weeks ago during the debate on the composition of the county assembly service board.Boru admitted that he grabbed the Mace after the speaker ignored the opposition a chance to contribute to the debate for the nominees of the County Public Service Board.He said the new speaker’s leadership style was unacceptable as he was dividing people on ethnic grounds in a county that already has a history of tribal conflicts.“Jobs are distributed between two communities, the matter is already in court, the suspension is a total injustice because I have not been given an opportunity to be heard,” said Boru.The former County Assembly Majority leader said the county assembly speaker refused to follow the standing orders and instead used Rule Number 1 which allows him to take disciplinary measures based on his decision.“There are members of the county assembly who have ganged up to frustrate other communities,” added Boru.Boru said the Speaker was not qualified for the job, claiming he was making decisions based on hearsay.
