A nominated member of the Garissa County Assembly has said she will table a motion that will seek to ban the use of Maslaha.

Speaking in Garissa on Thursday, Ms Fatuma Abdi condemned the use of maslaha in solving issues of rape and other forms of sexual violence adding that the system was contributing to the rise of such cases in the area. 

The MCA explained that women legislators will table a motion before the National Assembly to ban the use of maslaha which is a commonly used system of dispute and conflict resolution. 

She urged all their male counterparts to support the motion when it is tabled for debate. 

The MCA noted that elders, chiefs and any individual who use maslaha in solving rape or any form of gender based violence will be arrested and prosecuted.

“We will table a motion that will ban the use of Maslaha. We refuse and condemn use of maslaha as a form of settling rape cases within our communities. The law we intend to table will also punish elders found to be promoting maslaha on rape cases.”

“Any elder found to have participated in maslaha will be jailed regardless of his status in the society. We shall, as women legislators, come together to marshal our like-minded male counterparts to ensure this bill passes without any hitch,” said Ms Abdi.
