According to Chief Magistrate Margaret Wambani, Chomba's defense team was not ready for the case to commence.

"Despite the prosecution side having four witnesses, the defendant side prayed for some time to go through the charge sheet and prepare for the case to commence," she said.

She added: "Therefore the case is adjourned and will be heard on 12th September 2016."

According to the charge sheet, on the 19th July 2016 at the Eldoret Naivas market, Chomba allegedly made inciting utterances against the Nandi community.
