The Maendeleo Chap Chap Party says it will be seeking to be enjoined in the suit by the Attorney General Professor Githu Muigai about the illegal People’s Assemblies.

In his twitter, the Maendeleo Chap Chap Party leader, Dr. Alfred Mutua said they will be asking the court to declare that all MCAs who unconstitutionally voted for People’s Assemblies to have automatically resigned.

On Monday, the Office of the Attorney General filed a petition in court challenging a move by county assemblies allied to the National Super Alliance (NASA) to establish People’s Assemblies.

In the petition filed by the Deputy Chief State Counsel, Charles Mutimba, the told a Milimani court that the actions by 15 county assemblies which have so far constituted the forums were a violation of the Constitution and should, therefore, be quashed.

Muigai also sought prohibitory orders restraining other county assemblies from establishing People’s Assemblies.

He noted that unless the matter is certified urgent, public resources will continue to be spent on unconstitutional activities contrary to the Constitution and the Public Finance Management Act.
