A 35- year-old mechanic was on Tuesday arraigned at a court in Nakuru to face charges of attempted rape and committing an indecent act with a minor.
According to the charge sheet, Antony Mwiki, a mechanic based in Njoro sub-county attempted to rape an underage on December 27 last year, contrary to section 9 of the sexual offences Act 2006, laws of Kenya.
The prosecution desk told Senior Principal Magistrate Gerald Mutiso that at around 4pm on the said day at Kwa Mwaura village in Njoro sub-county, the accused, who was a neigbour of the girl’s family enticed her using a piece of cake and bread before she entered his house.
The prosecution held that the accused, having knowledge of the absence of the girl’s mother, who is single and who had left her behind in charge of her sibling, a three-year-old brother tried to commit the offence, but her mother, a fruits and vegetables seller at the local shopping centre unexpectedly came back home.
Upon enquiry of her where about from her brother, she found her daughter in the accused’s house eating a piece of a cake and bread.
The court was told that the mother, after making thorough interrogations to her daughter established that the accused had tried to rape her while indecently touching her private parts.
The prosecution said that the mother reported the matter to Njoro police station before the accused was arrested two days later, after going under cover.
He was remanded in custody after failing to raise a cash bond of Sh100,000 or cash bail of Sh50,000.
The case will be heard on February 5.
