Former Gem MP Jakoyo Midiwo now wants the ballot papers used in the August General election recounted and scrutinized.
According to Midiwo, a cousin to the Former Prime Minister Raila Amolo Odinga, told the court that the outcome of the parliamentary outcome does not reflect the will of the people.
The vocal politician accused the Independent Electoral and Boundaries Commission (IEBC) of creating room for the rival to engage in malpractices that saw him lose the contest.
The former ODM deputy minority leader has claimed that around 1,746 voters took part in the exercise without being identified through the KIEMs kits.
He also argued that the officers from the electoral commission colluded with the current area MP Elisha Odhiambo to deny him victory. He also claimed that his agents were barred from accessing the forms used in announcing the results of the polls
"Presiding officers in all 168 polling stations did not allow our agents to sign against the forms before leaving them behind as they left for the tallying centre," the former MP said, as quoted by The Star.
He further said that Odhiambo secretly met Gem returning officer Martin Omollo at an undisclosed hotel where they hatched a plot to rig him out during the election. On his part, Odhiambo has maintained that the elections were conducted in a free and fair manner.
