High court Judge Justice Luka Kimaru has directed National Resistance Movement (NRM) self Declared General Miguna Miguna if he so wishes to file a suit at the appropriate court in seeking for damages due to illegal detention by the state.
"The applicant will be at liberty to seek appropriate remedy in constitution petition or a suit for damages, for breach of his fundamental rights during the period which he was detained in breach of the orders of this court," the Judge ordered.
The court also noted that it would not require the appearance of Inspector General Joseph Boinett and DCI boss George Kinoti since there appearance would not serve any useful purpose as Miguna Miguna had already been produced in court.
Miguna Miguna was arrested on Friday at his home in Runda in a dramatic arrest that left his house vandalized.
Miguna miguna was released on an anticipatory cash bail of Sh 50000. The court ordered Miguna Miguna be released whether he had been charged in any court.
Lawyer Otiende Amollo expressed fears that the police might not release Miguna Miguna since he wasn't physically presented before Justice Kimaru.
Opposition leader Raila Odinga as also presented at the court in solidarity with Miguna Miguna's lawyers.
