Former Nairobi County gubernatorial candidate Miguna Miguna has taken on Attorney General Prof. Githu Muigai for 'lying' over his position on the tenure of President Uhuru Kenyatta after the expiry of 60 days of the Supreme Court ruling for IEBC to conduct fresh presidential elections.
Contrary to the views of other legal experts who have warned of a risk of having a constitutional crisis if IEBC fails to conduct elections within 60 days of the Supreme Court ruling annulling Uhuru's win, Muigai argues that the incumbent President continues to enjoy full Executive authority as the constitution doesn't provide for a caretaker or transitional government.
But while dismissing Prof.Muigai's argument, Miguna says that President Kenyatta is enjoying limited powers during temporary incumbency.
"The MORTICIAN G. Muigai is lying. Pursuant to Art. 134 @UKenyatta is exercising LIMITED 'powers during temporary incumbency," Miguna said in a post on his Facebook account.
During his address on Thursday, President Kenyatta said that there will be no power vacuum in Kenya even IEBC fails to conduct elections within 60 days of the Supreme Court ruling that nullified his election.
