On Wednesday, the department of immigration handed Miguna's passport destroyed.

According to lawyer Miguna, the government defaced his passport to deny him his right to return to Kenya.

Immigration boss Gordon Kihalangwa earlier surrendered Miguna’s passport to court in compliance with Justice Luka Kimaru’s directive.

It means that the Canadian based lawyer will have to apply for a new one.

"What the illegitimate government has done is to deposit a defaced passport in defiance of the court order. This must be seen in light of the respondents’ continued defiance of court orders. We must prove them wrong. The respondents believe, wrongly, that the guns they wield are far superior to the courts. The struggle against the purveyors of impunity and abuse of power will continue," said Miguna in a statement.

The passport was issued on March 23 2009 and confiscated on February 6.

Miguna was arrested and deported to Canada over his role in the swearing -in of Raila Odinga on January 30.
