In his detailed judgment on his decision to uphold Uhuru's win, Prof. Ojwang' noted that the petitioner failed to provide enough evidence to warrant the nullification of Uhuru's win, a position Miguna doesn't agree with.

"To JB Ojwang': Evidence needs to be credible; not 'objective' unless it is from an expert witness.Stop narrating; analyse (sic)," Miguna said in a post on Facebook page.

In his earlier post, Miguna disagreed with Prof. Ojwang's decision to uphold Uhuru's win, saying that cases are primarily determined on the basis of the evidence presented before court.

"JB Ojwang's scholarship isn't in doubt but he forgets that cases must be determined primarily on the basis of the evidence before the court," said the former Raila Odinga advisor.
