According to Steve Ogolla, Miguna ought to have been given the opportunity to defend himself, before being deported to Canada.

''As far as Miguna's deportation is concerned, the High Court will reverse this decision as illegal for want of due process, and violation of the right to fair administrative action, the right to be heard and legitimate expectation,'' Steve Ogolla said.

The legal expert was speaking today on an early morning television programme in a panel discussion.

His comments come in the wake of a national debate on whether the deportation of Miguna Miguna was legal.

Miguna clashed with the authorities after being involved in the controversial swearing-in of opposition leader Raila Odinga.
