Renowned layer Cliff Ombeta has offered his legal perspective on why his client Miguna Miguna will not sign immigration forms to regularise his presence in the country as demanded by authorities.
Mr. Ombeta said that they had advised Miguna not to sign the forms as that would be akin to trapping himself and doing so would be consistent with a court order requiring authorities to release him.
''No he has not signed any documents yet and our advise to him is that he should not sign those documents because first of all, if you remember, Justice Kimaru had maintained that his extradition or removal of Miguna was illegal and the orders saying that he was not a Kenyan citizen was also illegal, therefore, the status quo had to be maintained which means he is still a Kenyan citizen,'' Lawyer Cliff Ombeta said.
Cliff Ombeta was speaking today at JKIA outside the closed section that Miguna is reportedly being held.
Immigration authorities insist that Miguna has to append his signature to certain documents to regularise his arrival in the country.
Ombeta said that signing the documents would defeat the case that Miguna's legal team was building against the state.
