Speaking shortly after High Court Judge Luka Kimaru declared the deportation of the self-declared National Resistance Movement (NRM) general illegal, lawyer Otiendo Amollo said the ruling had reinstated the authority of courts over public officers.

“This judgement has reinstated the supremacy of the constitution and the authority of the law and the courts over public officers and overall Kenyans,” said Amollo.

Amollo, who is also the Rarieda MP, said the High Court’s judgement should act as a warning to public officers who disregard the law.

“It has reaffirmed the authority and independence of the judiciary as one of the very few institutions left in this country that is functioning independently and therefore any threat to that independence must be defended by Kenyans for the benefit of Kenyans,” said Amollo.

“Let it be a lesson to anyone, public officer or otherwise, who believe they can do whatever they want despite the law that that is not possible,” he added.

On his part, lawyer Nelson Havi said the government must obey the court ruling and allow Miguna to return to the country.

“We will be waiting for them in the Court of Appeal. Miguna Miguna must come back home and that decision will not be made by Fred Matiang’i or Karanja Kibicho. Kenya does not belong to a few of them,” said Havi.
