A minor on Tuesday denied being in possession of 20 litres of changaa in a Kisii court.
She was part of a group of illicit brewers who were arrested during a police swoop in the area yesterday.
Before Chief Magistrate John Njoroge, the Form Three student denied committing the offence contrary to sub-section 1(b) in Section 7 of the Alcoholic Drinks Control Act 2010 according to the Kenya Gazette supplement of 2010.
She had previously admitted the charges but sought to change her plea through her lawyer Mr Denis Nyakundi.
The chief magistrate allowed her to change her plea to not guilty as charged.
Mr Nyakundi asked the court to allow the accused to be charged as a minor, saying she is a Form Three student at Gesarara High School.
“Your honour, we would like the court to take notice of the fact that the accused is a minor,” said Mr Nyakundi.
Chief Magistrate Njoroge ordered defence counsel to produce the minor’s birth certificate as proof of her age.
She denied the offence and was remanded at the juvenile detention centre at Manga awaiting her appearance in court for mention of the case schooled for April 21, 2017.
