Former President Daniel Moi's grandson has been arraigned in a Nakuru court for alleged theft.
Collins Toroitich Moi appeared before Chief Magistrate David Kemei on Wednesday where he was accused of stealing two smart phones valued SH19 000.
Moi is alleged to have stolen the two phones on July 17 from her daughter May Chelimo and another from Chelimo's friend Betty Chebet.
The plea was taken in chambers following the request by the defense counsel through lawyer Ochang' Ajigo.
The lawyer challenged the prosecution for failing to arraign the accused until 48 hours which he said violated his constitutional rights.
“The accused was arrested on Monday July 25 at working hours and has not been charged until today the 27. This is total infringment of the rights of my client,” Ochang told the court.
According to Ochang' , the accused had called her daughter, a second year student at a local university for a lunch in a hotel at Nakuru where she came with her friend.
“Moi is the father to the first complainant, Chelimo. As a father, you expect him to invite his daughter for lunch and she came in the company of her friend, the second complainant,” Ochang' said.
Ochang' added that as the three were eating in a joyful mood, Moi decided to take the phone away from the table to have a smooth interaction.
“After the meeting, none of them remembered her phone after which they boarded a taxi. At the time they were alighting from the taxi, they left the phone in the taxi which has not been traced to date,” added Ochang'.
He says there were efforts to have the matter settled at a family level but the family insisted to have it come before the court.
“The mother is a former friend of the accused and seems to have bitterness against him making him opt to use the court. He was ready to repay the phones,” Ochang' continued.
