A Nakuru court on Monday gave former President Daniel Moi's grandson, Collins Toroitich, two weeks to know his fate on phone theft case.
Toroitich was arraigned in court on July 27 for allegedly stealing two smart phones on July 7 worth Sh19 000 belonging to his alleged daughter Mary Chelimo and her friend Betty Chebet after a lunch at a Nakuru hotel.
Through lawyer Ochang' Ajigo, Toroitich told the court that he has written a correspondence to the Director of Public Prosecutions (DPP) Nakuru branch to have him examine the prosecution file. He further said that the families are discussing to have the matter handled outside court.
“I have furnished the prosecution with a copy of the letter I wrote to the DPP Nakuru to examine the file to see if this matter warrants prosecution especially because the families are discussing to have the case settled out of court,” Ochang' told the court.
The prosecution confirmed receiving the letter dated August 11 and asked the court to be given two weeks to peruse the letter and get directions from the DPP.
“If the families are working to have the matter settled out of court, we have no objection. We are requesting the matter be mentioned in two weeks time so that we may get directions from the DPP and see the issues indicated in the correspondence,” said prosecutor Hillary Sungoiyo.
The Chief Magistrate, David Kemei directed thet the case be mentioned on August 19.
