Mombasa chief whip and nine MCAs are expected to lose their jobs over failure to meet the requirements envisaged in the Leadership and Integrity Act.
Among the affected leaders are Khamisi Mwabashiri (Mjambere), Mofard Amur (Old Town), Dancan Onyango (Mikindani), Paul Onje (Junda), Enoch Mwadziwe (Mwakirunge) as well as deputy speaker Rashid Mswabah.
Also equally troubled are the nominated members Serrah Nyamvula, Beatrice Kai, and chief whip Omar Meti.
Ethics and Anti-Corruption Commission (EACC) CEO Halakhe Waqo in a communique to the county assembly, indicated that the assembly was supposed to gazette the Leadership and Integrity Code in 90 days of approval, with the assembly’s state officers signing and committing to the code in 14 days after the gazettement.
However, Waqo said that the officers had not written back to show their commitment even after the commission gave them an extra 14 days to do so.
The final deadline elapsed on Tuesday leaving the nine out.
“Failure to comply with these requirements will leave the commission with no option but to institute the relevant legal proceedings without further reference to you,” Waqo warned.
EACC Ethics and Leadership Development Department acting deputy director Eric Ngumbi on Tuesday revealed that the nine had an unclear future as their jobs were at risk.
“The legal process has been activated. EACC will file a petition in the High Court for their removal from office under article 194 (1) (c) of the Constitution,” Ngumbi said, further revealing that letters to summon them were being prepared.
“Expect arrests of those who will fail to honour summons,” Ngumbi said.
