A Mombasa based court has dismissed a request that had been issued by Nominated Senator Emma Mbura.

Mbura had moved to court to file an application that sought to compel a rights activist, Mr Kalinga Mgandi, to publicly disclose his phone's Personal Identification Number (PIN) in a bid to aid investigating police to fully verify his personal WhatsApp account.

Kalinga is currently facing four charges of misusing a government licensed telecommunications system.

This comes after he claimed to have been involved in secret romantic affair with the outspoken senator through a popular social media platform.

Issuing a ruling on the application, Mombasa Principal Resident Magistrate Nicholas Njagi dismissed the request, saying it lacked merit as it was brought to the court through irrelevant constitutional provisions.

Mgandi and Senator Mbura’s supporters publicly got into a bitter exchange of words after the application's dismissal, disrupting other court proceedings.

The police manning the court were forced to intervene to restore sanity among the rival supporters.

The magistrate said the courts have a legal mandate to protect the rights of the accused and that it was his core duty to adhere to the constitution.
