A Mombasa-based business firm has sued Nakumatt supermarket over unpaid rent. The firm, Ideal Locations Limited wants the supermarket chain compelled to pay Sh26.6 million arrears for rent, promotion funds, and service charges.The complainant also wants the management of the supermarket to vacate its City Mall space within seven days.Through lawyer Willis Oluga, the firm has asked the court to direct the managers at Nakumatt to settle all the accrued payments before vacating the premises. Oluga told the court that the supermarket has failed to adhere to the payment deadlines as agreed. According to the lease agreement, the supermarket is expected to pay rent by 7th of every month, which has not been the case.The firm also wants the court to declare that the supermarket breached a sub-lease agreement dated June 9, 2014. “The defendant should vacate the suit premises to enable the plaintiff lease out the same to another tenant who is willing and capable of making regular payments,” the suit by Ideal Locations reads in part.Nakumatt has further been accused of failing to pay the service charge, electricity bills and promotion funds among other forms of payment as per the lease agreement.
