Mombasa County Assembly Speaker Thadius Rajwayi has been served with a court order barring him from presiding over House sessions.
Deputy Speaker Rashid Mswabah on Tuesday told Mombasa MCAs that the notice of a pending motion to discuss the speaker's fate could not proceed due to the court order.
“As a result of an issued court order, we cannot proceed to discuss the notice of the motion until the speaker's application for stay is heard and determined,” said Rashid.
The new development comes after a section of MCAs who had sought the speaker's removal from office, headed to court on Monday demanding an order to bar him from presiding over House sittings until his case is heard and determined.
Judge Patrick Otieno of Mombasa High Court said the embattled speaker, having stepped aside, would not preside over any of the proceedings of the assembly pending further directives of the court.
Last week, Rajwayi temporarily stepped aside to allow members to debate a notice of motion, which had accused him of corruption, abuse of constitutional office and incompetence.
