Machakos MP Susan Musyoka is facing arrest after she told President Uhuru Kenyatta to commit suicide or resign over corruption.
Machakos CID chief Henry Ndombi said on Friday the lawmaker had been summoned to record a statement over the remark published in local dailies on Wednesday.
He said the remarks amount to treason whose penalty on conviction in death.
Ndombi said after the summon, the MP failed to show up to record the statement.
He however, said her lawyer, Daniel Maanzo showed up accompanied by Machakos Deputy Governor Bernard Kiala.
Maanzo addressed the media and reported he had gone to the CID office inquire about the case.
He said his client had gone to hospital and would report to the CID office later in the day. The MP however, did not show up.
"Musyoka is expected to record a statement in relation to a press statement she issued a few days ago; she talked of a leader in connection to failure to end corruption and gave quotes by other leaders," he said as quoted by the Star.
"There is an indication that she will be charged with treason under section 40 of the Penal Code, which is actually a very old law that Parliament should have amended in line with the new Constitution."
He said the charges are politically motivated.
Kiala said the utterances were common among politicians but nothing is always done to them.
