Outgoing Teso South MP Mary Emaase has filed a petition at Busia High Court challenging the election of Geoffrey Omuse as the MP elect.
According to Emaase, IEBC erred in declaring her opponent the winner yet she had beaten him with over 1000 votes.
“I have opted to move to court to seek justice which I believe will be done. The decision has affected the will of the people of Teso South. We believe the court will look at the facts of the case to prove our case and deliver a fair judgment,” Emaase said.
Emaase who was defending her seat on a Jubilee party ticket, rubisshed claims that the area was an opposition zone something that gave her opponent a win.
The ODM MP elect Geoffrey Omuse is the first respondent and IEBC second respondent.
Evans Ondieki the petitioner's lawyer said they have a strong case which they hope will be dispensed by the end of December and justice delivered to her client as stipulated by the law.
Ondieki pointed out that there was fraudulent tabulation and tallying of figures by the Constituency Returning Officer from various polling stations.
“There are polling stations where the first respondent was added 100 votes and others where my client was denied more than 50 votes. My client won by more than 1000 votes and she was not declared the winner", said lawyer Ondieki.
Busia County is believed to be opposition, NASA zone.
