Hearing of an appeal by Nandi Hills Member of Parliament Alfred Keter against a ruling that nullified his win in the August 8 poll will now be heard in Eldoret.
Keter had filed an appeal at the Kisumu Court of Appeal but on Tuesday during pre-trial, it was ruled that the case is brought back in Eldoret.
This is after Bernard Kibor Kitur who successfully contested Keter’s win in last years poll requested that the case is heard in Eldoret as he, together with his witnesses could not be able to travel to Kisumu due to financial constraints.
On March 1, the then Eldoret High Court judge Kanyi Kimondo declared Keter’s win null and void on grounds that the Nandi Hills Parliamentary election was not conducted in a free and fair environment.
This is after the petitioner, Kitur who finished a distant second behind the MP successfully convinced the court that Keter conducted illegal campaigns on 6th and 7th of August which affected the outcome of the election.
Keter, however, insists that he did not conduct illegal campaigns and wants the Court of appeal to overturn a High Court decision that annulled his win.
Hearing for the appeal has been set for May 18.
