The father of Tom Cholmondely has sued MP Shah Hospital citing refusal to release his late son’s medical records.Cholmondely died after undergoing a minor, non-life-threatening hip replacement surgery.
His father Hugh George Cholmondeley said the hospital has still not yet given them the reason for his son's death.
The 81-year-old argued the hospital admitted that the post-mortem results could not show his son’s death and after a year, they still can't establish what killed him yet they refused to release his medical records to help the family use an independent pathologist to find the cause of the death.
"Our worry is that failure by MP Shah Hospital to release the records has put at risk my son’s multi-billion-shilling estate. We cannot process the death certificate to enable us take care of the properties according to his wishes,” Delamere swore in an affidavit that was filed at the Milimani High Court.
“The direct consequence of the hospital’s unlawful action is that no letters of administration can be taken out in respect of the deceased for purposes of administering his vast estates according to his wishes,” said Delamere.
