A Jubilee MP now wants the court to compel Opposition leader Raila Odinga and his deputy Kalonzo Musyoka to take part in the fresh presidential election set for October 26.Raila has maintained there will be no election if the IEBC does not meet what they have termed as 'irreducible minimum' demands which include sacking CEO Ezra Chiloba.Pokot South legislator David Pkosing claims the NASA leaders are planning to secure power through a crisis triggered by failure to hold the repeat poll within 60 days as directed by the Supreme Court on September 1.Through lawyer Kibe Mungai, Pkosing wants the court to declare that any action by Raila, Kalonzo, or any other NASA principals to stop the repeat presidential election is an act of treason and they should be held accountable.“Mr Odinga, being one of the candidates nominated to contest in the election is bound by the Supreme Court decision and cannot threaten to boycott the election. Any action to subvert or interfere with the elections is in contempt of the Supreme Court,” said Mungai, as quoted by The Standard.
The lawyer argued that if the Opposition politicians make good their threat to snub the election, there will be a constitutional crisis that can plunge the country into uncertainty.“The threats by NASA that fresh presidential election will not be held as scheduled may actually materialize in a significant number of constituencies and counties thereby putting Kenya’s constitutional order into jeopardy,” Mungai was further quoted by the local daily.The court directed the MP to serve Raila and Kalonzo with petition papers.
