Kiambu Township MP Jude Njomo has moved to court seeking orders to compel the electoral commission to conduct repeat presidential election slated for October 26.
The Jubilee legislator also wants the court to compel the Opposition alliance, NASA, to allow the IEBC conduct the fresh poll as scheduled.
"This Court has a sacred duty to ensure the fresh presidential election is held as ordered by the Supreme Court and that any attempt or political conspiracy to establish a new government by triggering a constitutional crisis is nipped in the bud," Njomo argued.
NASA led by Raila Odinga has vowed to stop the election in its strongholds, calling for nationwide mass protests to push for electoral reforms on the Election Day.
IEBC chairman Wafula Chebukati has also expressed fears that the electoral agency may not conduct credible polls citing political interference and a divided commission.
"The burden placed on me as chairman is huge. Yet, I can't move forward with a divided commission. I can't move forward when presidential candidates refuse to put their personal interests aside and, for once, serve their country," a troubled Chebukati said.
