Kenyan members of parliament stand to lose their overriding power over CDF matters following a ruling by the Court of Appeal on November 25 which found sections of the CDF Act 2013 to be in violation of the constitution and the principle of separation of powers.
Except for certain problematic sections; 24(3)(c), 24(3)(f) and 37(1)(a), the whole CDF act is completely operational and subject to implementation.
A three-judge bench removed the said sections from the contested piece of legislation.
''The provisions of the act, which violate the doctrine of separation of powers have been clearly identified.'' Part of the ruling read according to an article by the Daily Nation.
The judges belabored the significance of the CDF fund in the development of the country and said that the decisive determination of the matter was crucial to avoid confusion going forward.
Doubtless, the decision to roll back the powers of MPs over CDF is sure to trigger unease amongst the legislators as CDF has been a platform of their political campaigns.
