Members of Parliament have called on the High Court to dismiss a case filed by two activists challenging the legality of a new law seeking to freeze the release of the Constituency Development Fund (CDF).
Led by Eldama Ravine MP Moses Lessonet who swore an affidavit, the MPs ague that CDF projects and poor students depending on the fund for bursaries will be affected if the kitty is frozen.
During a House sitting, the lawmakers expressed their 'love' for the CDF kitty citing that it not only helps in developing the constituencies but also benefits young bright scholars who have no other means of getting school fees.
In the case, the petitioners, Wanjiru Gikonyo and Cornelius Oduor Opuot, want the court to declare CDF unconstitutional on grounds that it creates a third level of government not contemplated in the Constitution.
However, the MPs say the cash has helped many people and if it is done away with, it will hinder development for the country.
