The son of Matuga MP Hassan Mwanyoha has told the Mombasa High Court that he is suffering in prison.
Mafanikio Mwanyoha alias Fani Hussein, who is serving a death sentence for robbing a tourist, on Monday told the court that he was suffering at the Manyani Maximum Prison.
Mwanyoha told Mombasa High Court Judge Justice Dorah Chepkwonyi that his life has been unbearable after being sentenced to death in April, and wants to appeal against the judgement by the Magistrate Court.
“Your honour, I am suffering in prison, life there is harsh and I find it unbearable. I need your help,” pleaded Mwanyoha.
Justice Chepkwonyi however postponed the hearing of his appeal case after a file went missing in court.
The court heard that the file was still at the Kwale Court where Mwanyoha was convicted.
Justice Chepkwonyi also told Mwanyoha that the proceedings of his case had not been typed and therefore could not be availed to him.
Mr Mwanyoha was charged alongside Mr Ali Hussein with robbing a tourist, Mr Peter Schadwsky at Bougan Villa Estate in Msambweni Sub-County.
The two are currently serving death sentences after they were found guilty for violently robbing Mr Schadwsky of property valued at Sh14,625 on August 19, 2016 in Diani, while armed with a knife.
The court heard that they stole a bag, an LG mobile phone, a pair of spectacles, a company ID card, and five credit cards.
The case will be mentioned on September 21, 2016.
