A voter had gone to court in Nyamira county demanding the nullification of Kitutu Masaba parliamentary elections results that saw a jubilee candidate emerge victorious.
According to Justua Omiti, out of 184 polling stations, only 153 polling stations submitted data to constituency polling station while the other 34 sation had no data submitted.
Shadrack Mose of jubilee party was declared the winner by Independent Electrol and Boundaries Commission (IEBC) after garnering 33,386 votes with Orange Democratic Movement's (ODM's) national treasurer, Timothy Bosire, coming second with 19,262 votes.
In the affidavit filed by Noah Akala, one of the witness in the matter, says that according to his analysis forms 34A's obtained from IEBC online portal, there were 170 polling stations out of 187 stations with irregularities in numbers in all the six elective positions.
Justus Omiti once filed a petition in 2011 at Nyamira high court that saw the nullification of the then Kitutu masaba MP Walter Nyambati Victory in what the court termed 'massive irregularities'.
The Nyamira high court has however asked the both parties to avail themselves in the court next week Tuesday.
