Amani National Congress leader Musalia Mudavadi has called on Interior Cabinet Secretary Joseph Nkaissery and Attorney General Githu Muigai not to ban the anti- IEBC protests.

He further accused the two of doing things their own way and not as per the Constitution. Mudavadi termed the move by CS Nkaissery as a breach of law.

“For all practical purposes, the CS has suspended Chapter Four on the Bill of Rights in a blinker of Executive authorisation to also curtail freedom of association. The remedy in banning is not provided for in any law hence suspicion that Jubilee is intent on governing through unconstitutional edits and introducing military authoritarianism,” said Mudavadi in a press statement.

Mudavadi further accused the Jubilee government of trying to run the country their own way. 

He said the  such kind of action is unnecessary unless it is admission that Executive, legislative and judicial branches of government have failed to function effectively.

He pointed out that a decision made by Jubilee to stop the protests can only be arrived at if the other forms of government have failed to work- solve the conflict.
