A 30-year old Muhoroni man, has been sentenced to five years in jail for assaulting and injuring his son.

The incident occurred at Machorwa village in Muhoroni on July 14, 2013.

The victim, who was in class 5 at the time of the incident, is said to have spent a night away from home, a move which angered his father and resulted in the battering.

The court heard that the boy failed to give a satisfactory answer over where he had spent the night. In a fit of anger, the accused, Thomas Owino picked up a cooking stick and used it to strike his son, fracturing his left leg and arm in the process.

Owino then left the injured boy sleeping in the house as he went out to look for money to take him to hospital.

However, upon his return, the mother had already taken the child to hospital where he was undergoing treatment.

The mother later reported the matter to the police.

Owino surrendered himself to the police upon learning that they were after him.

Appearing before Kisumu chief Magistrate Lucy Gitari on Friday, Owino pleaded guilty to charges of aggravated assault.

He will however, serve an effective two-year jail term after Gitari suspended three years on condition of good behaviour.
