A murder case before a court in Kisumu on Wednesday failed to proceed as the accused sort the charges to be read afresh.
Wilson Ochami who was present before court was accused of murdering Samwel Odera at Obunga junction in Kisumu County on August 3, 2014.
When he appeared before the Senior Resident Magistrate Ezekiel Obina on August 12, of the same year he was not able to stand for plea pending a medical assessment.
Mr Obina then directed that the accused be escorted to the Jaramogi Oginga Odinga Teaching and Referral Hospital (JOOTRH) for a psychiatrists report.
He also directed that an advocate be appointed from the list of advocates handling pauper briefs to represent the accused.
Mr Ochami was then to be remanded pending the taking of the plea.
In the subsequent court proceeding the accused who was arraigned before Judge Esther Maina pleaded not guilty to the charges and was released on a bond of Sh2 million bond with similar sureties.
On Wednesday when the matter came up in court before Senior Principal Magistrate Thomas Obutu, the case was not able to proceed on grounds that there were orders that the charges be reduced to man slaughter which were not yet executed.
The accused told court that he had no intent of killing the deceased hence pleaded for the crime to be reduced to manslaughter to which the court granted.
The charges were to be read afresh but failed to kick off.
On Wednesday, Judge Obutu directed that the matter be presented before court on April 13 for the charges to be read afresh.
He also directed that the prosecutor peruses the file in three weeks and accord the accused with copies of the evidence documents that they intend to rely upon.
