A case in which a man was charged for murdering a brother over Sh70 was on Tuesday postponed as the witnesses failed to avail themselves in court.

The case was set for the hearing but failed to kick off as the prosecution sort to be given time to summon the remaining witnesses to court.

Isaac Omondi was charged for the murder of Erick Odhiambo on April 19, 2014 at their home in Kombewa sub location in Kisumu County.

Mr Omondi who has been mentally challenged since the case began was not able to plead to the charges when the case first came to court on April 24, 2014.

The Senior Principal Magistrate Thomas Obutu ordered that the accused be taken to Kisumu District Hospital for a mental assessment but it was not until the beginning of last year that the accused was found devoid of any mental illness hence was fit to stand trial.

In the subsequent court proceedings, the father to the accused told court that Omondi had tendencies of scaring villagers away while armed with a panga.

“My son has tendencies of beating me up. He would come home armed with a panga that he usually walks with and would kick the sufurias from where we make meals. In many occasions he has sold my cloths and other household items,” said the father.

Esther Atieno the widow of the deceased who also told the court that Omondi always walked with the panga forcing villagers to flee from him whenever they encountered him.

She said he had a habit of kicking everything he came across and would kick sufurias whenever he found her cooking leaving them with no meals to eat.

“I was even keeping my cloths at a neighbours home because he would gather them and sell them at a throw away price. I would go and change clothes at my neighbours house everyday,” said the teary Atieno.

She said on the fateful night he came home armed with a panga but she requested the husband to deal with him and find out what the problem was since she did not want any confrontations at her house.

“I managed to snatch the panga from Omondi and hide it in the bedroom and went outside but on return Omondi had already taken the panga. He cut my husband in the nose and arms and he fell to the ground. He cut him again in the neck and he died instantly,” said the widow.

On Tuesday when the matter was brought before judge Esther Maina, the court proceedings were adjourned until May 19 to give time for the prosecutions to issue summons to the other witnesses who are yet to give their accounts of the incidence.
