A Malindi high court has begun hearing the murder case of a Nairobi businessman who was allegedly killed while on a family vacation in a suspected love triangle at Medina Palm Resort in Watamu on July 26, 2015.
The prosecution of the murder of Jimmy Baburam has 18 witnesses who are expected to testify this week against the wife Amina Shiraz who is accused of conspiring with her American lover Jacob Schmalze to kill her husband.
Three witnesses have since testified before Lady Justice Dorah Chepkwony including the late Baburam’s stepmother and wife of Rtd. Brigadier David Baburam, Mrs. Yadit Tesfay Baburam, Obrien Baburam a brother of the deceased, and a former house help Evelyn Nabwire.
All the three witnesses disclosed that they knew Schmalze the American fugitive suspected to be having an affair with Shiraz before Baburam died.
Both the Mombasa and Malindi courts issued warrants of arrest against him.
Detectives said the American fugitive escaped to the United States to avoid being charged with Murder.
Baburam was allegedly killed by Shiraz and the American fugitive who drowned him in a swimming pool.
Nabwire who was with the late Baburam’s family during the vacation in Watamu revealed that she found the American with a forehead injury on a fateful day.
She told the court that that night when the late Baburam died there was a party and she saw the couple and the American seated together.
