Elgeyo Marakwet Senator Kipchumba Murkomen has told off former Devolution CS Anne Waiguru over the Sh1.6 billion NYS scandal saying she should carry her own cross.

Murkomen now wants Waiguru prosecuted over the NYS scandal, noting the evidence against her is enough to have her prosecuted.

“I do not know whether Anne Waiguru is guilty, but the facts that have been presented on the table are enough for her to stand trial and prosecuted,” he said.

On Friday, Murkomen, while dismissing Waiguru’s claims that he benefited from the NYS loot, told the former minister to provide evidence to back her claims.

“If you know that I was paid by Ben Gethi or Josephine Kabura even a single cent, a dime or fifty cent, then lay it bare to the public,” said Murkomen.

He was responding to remarks by Waiguru who implicated Murkomen, DP William Ruto’s aide, Farouk Kibet in the scandal when she appeared before the Public Accounts Committee two weeks ago.

"I have asked Waiguru&any Kenyan who has an iota of evidence linking me to payments including legal fees by Gethi &Kabura," wrote Murkomen on his Facebook post.

“If she is not going to be charged for the corruption of the NYS, we could as well legalise corruption in this country,” said Murkomen.

He said he was ready to respond to the PAC or any other institution searching for the truth on the NYS scam.

"For the record, our client then Ben Gethi is yet to pay our legal fees. And for avoidance of doubt, I recorded a statement long time ago with EACC in response to Waiguru's preposterous allegations. I am authoritatively and with certainty waiting for the opportunity to respond to PAC or any other institution looking for the truth on this matter.

He said he has no apologies to make on behalf of his law firm, SMS Advocates for representing any client. 

"When we charge our legal fees we don't ask our clients how they make their money just the same way Anne Waiguru's doctor (he who Recommended lighter duties) didn't ask where she got her medical fees. Supermarket teller does not ask you to first account for your shopping money; neither does a Matatu tout ask where passengers get their transport fees nor does your pastor ask where you got the sadaka before you offer. We are advocates and lawyering is our business."

He asked the public to "wake up stop chasing wild goose."

" You either play darts with the war on corruption or you at least secure a conviction in a glaring case before us of two women carrying money in sacks. What has shocked me is that you are happy discussing legal representation instead of the loss of over Sh2 billion meant for the many unemployed and skilled youth in this great republic."
