Ngunyi via his Twitter handle on June 13, stated that he will sue Ouko for malice and malpractice.

He has also claimed that the the Auditor General's report is fuelled by politics from the opposition, Cord.

"I have instructed my lawyers to sue the auditor general for malice and professional malpractice. He is doing politics for Cord," stated Ngunyi.

Mr Ngunyi’s firm, The Consulting House, was hired to restructure the NYS in what later came to be referred to as the NYS five-Point Vision and was awarded two contracts.

According to the Auditor General, the first contract signed in March 2014 for Sh40 million and the second one was worth Sh50 million.

However, Ouko has stated that Mr Ngunyi was paid for the first contract but he (Ouko) discovered also that in the second contract, Ngunyi was paid Sh62.5 million

According to the auditor general, "payment of Sh12.5 million on April 21, 2015 was done using a copy of (the) invoice dated March 11, 2015, which had been used to support an earlier payment of the same amount done on March 16, 2015."
