Former Machakos senator Johnson Muthama will again face hate speech and incitement to violence charges.

The High Court has reinstated the charges against the National Super Alliance leader, following an appeal by the Director of Public Prosecutions.

A lower court had dismissed the case by the DPP, saying he abused his powers.

However, High Court judge Justice Grace Machari ruled that she did not believe the DPP abused his powers by bringing forth the charges against the former Senator.

"I find the application by the DPP merited and the same succeeds. I set aside the orders of the lower court issued on July 28, 2016. l substitute it with an order that the charge sheet filed by the prosecution before Milimani Chief Magistrate court be reinstated," Machari ruled.

Muthama, who two days ago claimed that top government officials were after silencing him, could be sentenced to three years in jail or fined not more than one million shillings, if found guilty.
