Former Machakos Senator Johnston Muthama is in trouble again. This comes after the High Court reinstated incitement to violence and hate speech charges against him.
Justice Grace Machari ordered the reinstatement after Director of Public Prosecution (DPP) Keriako Tobiko appealed an earlier decision by a lower court. The lower court had terminated Muthama’s charges.
“Muthama shall appear before the chief magistrate court on October 6 for purposes of taking hearing dates,” Machari said as quoted by the Star.
According to Machari, the DPP was in order to charge the vocal NASA politician. Muthama had been off the hook since July 28, 2016 but he will be back to court to prove himself innocent.
“I find the application by the DPP merited and the same succeeds. I set aside the orders of the lower court issued on July 28, 2016. l substitute it with an order that the charge sheet filed by the prosecution before Milimani chief magistrate court be reinstated,” she concluded.
