The Machakos senator Johnston Muthama has had all charges of hate speech against him dropped.
Chief Magistrate Daniel Ogembo made the ruling on Thursday morning stating that the senator could not be charged twice of the same offence.
Ogembo went further on to explain that it would not be lawful to have Muthama in custody for a case he committed way back in 2015.
The senator was one of the eight legislators who spent four days behind bars for incitement and hate speech.
The other seven were Suna East MP, Junet Mohammed, Aisha Jumwa (Kilifi), Florence Mutua (Busia), Moses Kuria (Gatundu South), Ferdinand Waititu (Kabete), Kimani Ngunjiri (Bahati) and Timothy Bosire (Kitutu Masaba).
The High Court had in 2015 barred the arrest of the senator after he was accused of hate speech against President Uhuru Kenyatta.
