Former Machakos senator Johnstone Muthama has sued the government for allegedly denying him a mining license.

Muthama filed a case in court against the Mining Ministry on Wednesday.

He said his firm Rockland Kenya Limited had incurred massive losses after the government denied it an export permit.

In the papers filed at the Milimani Law Courts, Muthama argues that the move is unconstitutional. 

“I verily believe that the refusal and or delay by the first respondent in proceeding to have issued to us export permits is in complete contravention of our rights as provided for in the Constitution and the Fair Administrative Action Act,” read part of the affidavit.

The former senator listed Mining Secretary and Attorney- General as the respondents in the suit.

Muthama, a politician, and prominent businessman was given a special mining lease in 1991 which was later extended to 1996.

The Ukambani politician renewed the license in 2012 to 2033 before the new development.  

He has questioned the move of the government to deny him the license, arguing that he has complied with all requirements.

The senator further says his firm has invested heavily in qualified personnel.
