Machakos Governor Alfred Mutua on Tuesday withdrew from court hearings citing bias from the judge. Trouble started after his lawyers announced their decision to pull out from the day’s proceedings alleging bulldozing from Justice Aggrey Muchelule.

Lawyers Wilfred Nyamu and Bernard Mung’ata said their withdrawal was in protest to the court’s insistence that the hearing would continue despite a notice of appeal by the governor to an earlier ruling by the same court that was still pending determination.

The governor had notified the court of his intention to file an appeal after Muchelule struck out an application that wanted former Kathiani MP Wavinya Ndeti’s petition, challenging Mutua’s re-election, dismissed.

However, while making its ruling on November 10, the court dismissed the prayer citing legal loopholes. Mutua had filed the petition pushing for the dismissal of the case, saying it was filed in contravention of the laws on election petitions. The court threw out his application on legal technicalities.
