Maendeleo Chap Chap Party on Wednesday moved to court challenging the constitutionality of the NASA's People’s Assembly Forum.
According to the party led by Machakos Governor Alfred Mutua, the assemblies are illegal.
In the case filed by lawyer Alfred Nyamu, Mutua’s political outfit argued the sixteen people’s assemblies including one in Machakos should be declared unconstitutional citing lack of legal basis.
“The purported establishment of the people’s assemblies via resolutions passed by the respondents amount to acts not authorized by the Constitution of Kenya 2010 hence contrary to Article 2 (2) of the Constitution of Kenya, 2010,” the petition read in part.
The party's secretary general Stephen Kilonzo asked the court to stop the assemblies from exercising their powers and mandate across the nation.
The move comes at a time when NASA leaders have maintained that they will not recognize the leadership of President Uhuru Kenyatta and his Deputy William Ruto following the inauguration into power.
The leaders argue that the duo is holding office unconstitutionally.
NASA leader Raila Odinga opted to take a controversial oath in a bid to mount more pressure on Jubilee for a fresh election on January 30.
